TERMS OF SALE

1 – Scope
These Terms and Conditions of Sale govern all sales concluded by Garçons Jeunes SAS with consumers on the website https://www.garconsjeunes.com.
They are accessible at all times on the website and prevail over any other document. Placing an order implies full acceptance of them.
The products offered include clothing, ready-to-wear garments, denim, fashion accessories, jewellery and textile accessories. Their essential characteristics are described on each product page, which you are invited to read before ordering.
Offers are valid while stocks last.

3 – Products
Products are described as accurately as possible. Photographs and illustrations are provided for guidance and are not contractually binding.
Our pieces are made by hand, in small runs, and some are produced only after the order is placed. Slight variations in colour, texture, finish or measurement may occur between two pieces of the same model. These variations are inherent to artisanal production, are described here before purchase, and do not constitute a lack of conformity.
Products offered as part of limited collections or drops may be available in very small quantities. We do not guarantee their permanent availability.
4 – Pre-orders
Some products are sold as pre-orders: they are produced after the order is placed, and shipped once production is complete.
The production and delivery period is stated on the product page before you buy. It forms part of the contract: by placing the order you agree to that period, which replaces the 30-day default of Article 8.
Payment is taken at the time of the order.
Pre-ordered products carry the same right of withdrawal as any other product. The 14-day period runs from the day you receive the item.
If the announced period cannot be met, we inform you and you may either accept a new date or cancel the order and be refunded in full.
Where production becomes impossible — in particular because a fabric or a component is no longer available, or because a maker we depend on fails — we inform you and cancel the order. You are then refunded in full within 14 days. No other compensation is due.
5 – Prices
Products are sold at the price shown on the website at the time the order is placed.
Prices are inclusive of all taxes. They are set in euros; where your country or currency selection displays another currency, the amount charged may vary with the exchange rate and the fees applied by your bank.
Delivery costs are not included in the product price and are shown before the order is confirmed.
We may change our prices at any time, but your order is invoiced at the price in force when it is placed.
Where a price displayed is manifestly erroneous — in particular a price out of all proportion to the value of the product — we may cancel the order and refund it in full, having informed you.
For deliveries outside the European Union, customs duties and import taxes are your responsibility.
6 – Orders
You select the products, add them to your basket, and can review and correct the details of your order before confirming it.
The sale becomes final once payment is validated and the order confirmed by us.
We may refuse or cancel an order on legitimate grounds: an existing dispute, suspected fraud, a pricing error, a stock issue or an unusually large order.
To prevent fraud we may ask you for supporting documents. If you do not reply within a reasonable time, or if fraud is suspected, we may cancel the order and refund it in full.
7 – Payment
Payment is due in full at the time of the order.
Accepted payment methods:

- Apple Pay
- Shop Pay
Payments are secured by our payment service providers. We never store your card details.
Where a payment is refused, reversed or charged back after the order has been dispatched, we may claim the sum owed, suspend the customer account, and decline further orders until the situation is settled. This does not affect your right to dispute a payment you did not authorise.
8 – Delivery
Products are delivered to the address you provide when ordering. You are responsible for the accuracy of that address; where a parcel is returned to us because the address was wrong or incomplete, reshipping costs may be charged to you.
Under Article L216-1 of the French Consumer Code, delivery takes place no later than 30 days after the contract is concluded, unless another date is agreed with you at the time of the order. For pre-ordered products, that other date is the period stated on the product page, as set out in Article 4.
Deliveries are carried out by independent carriers. You receive a shipping confirmation with tracking information where available.
If the applicable deadline is missed, you may cancel the order under the conditions of Articles L216-2 and L216-3. Sums paid are then refunded within 14 days of cancellation.
Under Article L216-4, the risk of loss or damage passes to you when you take physical possession of the goods — not before.
If a parcel is declared lost by the carrier, an investigation is opened. We propose a replacement or a refund once the loss is established.
Please tell us as soon as you can if a parcel arrives damaged or does not arrive at all — ideally within three working days for visible damage. Carriers impose short claim windows, and a prompt report is what allows us to obtain compensation from them. Reporting later does not remove any of your rights, but it may make the investigation harder.

9 – Transfer of ownership
Ownership of the products passes to you only once the price has been paid in full, in accordance with Article 1196 of the French Civil Code.
10 – Right of withdrawal
Under Article L221-18 of the French Consumer Code, you have 14 days from receipt of your order to withdraw, without giving a reason. This applies to every product we sell, including pre-orders, limited editions, drops and discounted items.
Informing us of your decision is enough — no prior authorisation is required. You are only liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
The cost of returning the product is yours, except where the product is defective, damaged or does not match your order.
We refund the price and the standard outbound delivery costs within 14 days of receiving the product back or receiving proof that you sent it.
The only exclusions are those set by Article L221-28: gift cards, and items made to your own specifications or clearly personalised — for example a piece cut to your measurements or bearing a personalisation you requested. Where such an exclusion applies, it is stated on the product page before purchase.

11 – Legal guarantees
All our products carry the legal guarantees, which apply free of charge and independently of any commercial gesture.
Legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code)
- You have two years from delivery of the goods to invoke it.
- During that period you only have to establish that the defect exists — not when it appeared.
- You may choose between repair and replacement, subject to the cost conditions set out in Article L217-12.
- Where repair and replacement are impossible, you may obtain a price reduction, or end the contract and be refunded in full against return of the goods, under the conditions of Article L217-14.
- The guarantee applies without cost to you.
Warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code)
- You may invoke it within two years of discovering the defect, and may then obtain a full refund against return of the goods, or a partial refund by keeping them.

12 – How our garments age, and how to care for them
This article describes the expected behaviour of our products. It is given to you before purchase so that you know what you are buying, and it forms part of the description of the goods.
Raw denim. Our selvedge denim is not pre-washed, in order to preserve the natural fibres. As a consequence, and by design:
- the fabric fades and creases where you move, and develops a patina specific to the person wearing it
- indigo may transfer onto light-coloured surfaces — seats, footwear, bags — particularly when the garment is new or damp
- the garment may shrink on its first wash
- two pieces of the same model may differ slightly in shade
These are the characteristics that make raw denim what it is. They are not defects, and they do not constitute a lack of conformity within the meaning of Article L217-5 of the French Consumer Code.
Hand-dyed and hand-finished pieces. Colour, texture and finish may vary from one piece to another and may evolve with wear. This is inherent to the process.
Care. Care instructions are given on each product page. Damage resulting from washing, drying, ironing or treatment that does not follow them — in particular an unsuitable temperature, a machine dryer, or a bleaching product — is not attributable to us and is not covered by the legal guarantee of conformity.
Normal wear and tear resulting from use is likewise not a defect.
13 – Liability
We are not liable for improper use of a product, normal wear and tear, or the characteristics described in Article 12.
Our liability is limited to direct and foreseeable damage resulting from a failure attributable to us.
These limits apply within the bounds permitted by law and do not affect the legal guarantees set out in Article 11, nor your right of withdrawal.
14 – Force majeure
Neither party is liable for a failure to perform caused by an event beyond its control, which could not reasonably be foreseen when the contract was concluded, and whose effects cannot be avoided by appropriate measures, within the meaning of Article 1218 of the French Civil Code.
This includes in particular: natural disaster, fire, flood, epidemic, war, riot, strike affecting a carrier or a supplier, failure of a maker or supplier we depend on, lasting unavailability of a raw material, prolonged interruption of energy or telecommunications networks, and cyberattack.
Obligations are suspended for as long as the event lasts. If it lasts more than 60 days, either party may cancel the order and the sums paid are refunded in full within 14 days. No other compensation is due on either side.
15 – Personal data
The personal data collected is necessary to process your order, deliver it and manage the customer relationship.
Under Regulation (EU) 2016/679, you have a right of access, rectification, erasure, objection, restriction and portability, exercisable at contact@garconsjeunes.com.

16 – Intellectual property
All elements of the website are protected by intellectual property law. Any reproduction or use without prior authorisation is prohibited.
17 – Archiving of the contract
For any order of €120 or more, we archive the record of the contract for ten years from the conclusion of the sale, in accordance with Article L213-1 of the French Consumer Code, and give you access to it at any time on request at contact@garconsjeunes.com.
18 – Proof
The computer records kept by us and by our providers, under reasonable security conditions, are considered proof of the exchanges, orders and payments between us.
The order confirmation and the invoice sent by email constitute proof of the contract.
19 – Severability
If any provision of these Terms and Conditions of Sale is held void, unlawful or unenforceable, the other provisions remain in force and continue to apply.
The fact that we do not enforce a provision at a given moment does not amount to waiving it.
20 – Governing law and complaints
These Terms and Conditions of Sale are governed by French law. If you are a consumer resident in another European Union country, you also retain the protection afforded by the mandatory provisions of your own country's law.

Under Articles L612-1 and following of the French Consumer Code, you are entitled to free access to a consumer mediation service. Write to contact@garconsjeunes.com and we will send you the details you need to refer the matter to a mediator.
Failing an amicable resolution, any dispute is brought before the competent courts under the applicable rules.

We may amend these Terms and Conditions of Sale at any time. The version applicable to your order is the one in force when the order is placed.
